Summary
The opposition, based on the opponents’ registrations and user of their mark LIVING, in respect of printed periodicals, was directed at only some of the goods and services specified in the application. Having taking all the factors into consideration the Hearing Officer, not without “some hesitation”, found that there was no likelihood of confusion, even where the goods were identical.
