Summary
The parties were unable to agree on several major points regarding the form of the order concerning entitlement to PCT/US99/06438 which led eventually to a breakdown in negotiations between them. At the hearing arranged to hear their views on the outstanding points, the Hearing Officer found that Mr Jevons had failed to persuade him that there was a good case for cross-royalty and he ordered that the provisions of section 36 should apply. On the form of the order, the Hearing Officer stated the options available to the parties for the prosecution costs for the application both past and future. He refused to make any order with respect of the marking of products or their packaging. A draft of the proposed order reflecting the matters agreed by the parties at the hearing or settled by the decision was attached to the decision to assist the parties in resolving the outstanding matters.
