Summary
At the earlier hearing (see BL O/5334/01) the Hearing Officer had declined to strike out parts of the opponents' evidence, or rule that their mark should be summarily revoked. The applicants appealed to the Appointed Person, but he declined to interfere with the Hearing Officer's decision; instead he recommended an early hearing of the substantive issues. The appeal was dismissed but no order was made as to costs (the respondents had not attended the hearing).
