Summary
The applicant did not provide any independent medical evidence to corroborate his assertion that his state of health was severe enough to excuse his failure to pay the fourteenth year renewal fee on the patent. To the contrary, the fact that, during the period in which the fee could have been paid, he paid the renewal fee on another patent was a clear indication that he was aware of the need to pay patent renewal fees and was capable of seeing that they were paid. The Hearing Officer refused to allow the request for restoration.
