Summary
The opposition to this application for protection in the UK of an International Trade Mark Registration, was based on the opponents’ Community Trade Mark registration of their mark SEROPRAM. The Hearing Officer decided that the basis for opposition was Section 5(2)(b). He found, however, that the marks would not give rise to a likelihood of confusion. The opposition under Section 5(2)(b) therefore failed.
