Summary
At the outset the Hearing Officer found that the amendment of the original specification as filed had not been in breach of Section 39(2). He went on to find that the mark was not excluded from registration of any of the provisions of Section 3(1). The Hearing Officer did not find the case under Section 5(4)(a) made out, neither did he find it successful under Section 3(6).
