Summary
The applicant for restoration was not the registered proprietor of the patent but claimed to be a person who would have been entitled to the patent if it had not ceased to have effect. This claim was based on (a) assignment negotiations which took place but not concluded before the final date for applying for restoration and (b) the prospect of acquiring the patent in satisfaction of a debt. The application was not properly launched because the applicant did not own the patent at the time of making the application. A request to substitute the name of a liquidator, when appointed, as applicant was also refused.
