Summary
In the light of the BALMORAL case the Hearing Officer concluded that the goods at issue must be considered as similar. The matter therefore came down to a comparison of marks. The opponent’s marks consisted of or contained various references to TOWERS or TORRES. The Hearing Officer concluded, however, that the word TORRE in the applicant’s mark was no more the essential feature than the word BARON. In consequence he concluded that there was no danger of confusion and the opposition failed accordingly.
