The complainant requested particular information about juror expenses for the period 1 July 2022 until 30 June 2024. The Ministry of Justice (the 'MOJ') provided some information, but withheld the remainder, citing section 35(1)(a) - the formulation or development of government policy and section 35(1)(b) of FOIA - Ministerial communications. During the course of the Commissioner's investigation, the MOJ said it no longer wished to rely on section 35(1)(b) of FOIA. The Commissioner's decision is that the MOJ has properly relied on section 35(1)(a) of FOIA and that the public interest favours maintaining the exemption for the reasons set out in this notice.
