The complainant has requested copies of email correspondence between Thanet District Council (TDC) and a particular councillor, regarding complaints about a community interest company. Initially, TDC disclosed some information, said that some information was exempt from disclosure under regulation 12(5)(d) (Confidentiality of proceedings) of the EIR and said that it did not hold the remaining information specified in the request. During the Commissioner-™s investigation, TDC withdrew reliance on regulation 12(5)(d) and said it did not hold any further information falling within scope. The Commissioner-™s decision is that TDC was entitled to rely on regulation 12(4)(a) of the EIR as, on balance, he is satisfied that TDC does not hold any further information.
