The complainant has requested Royal Borough of Kingston Upon Thames (the council) to disclose the identities of individuals that objected to a planning application. The council refused to disclose the information citing regulation 13 of the EIR. The Commissioner's decision is that the council is entitled to refuse to disclose the requested information in accordance with regulation 13 of the EIR. He has however recorded a breach of regulation 14(2) of the EIR by failing to issue its refusal notice within 20 working days of receipt of the request. The Commissioner does not require further steps to be taken.
