The complainant has requested information related to the COVID-19 Operations committee meetings held in May 2020. The Cabinet Office refused the request relying on the exemption at FOIA section 35(1)(b) -“ information relating to ministerial communications. The Commissioner-™s decision is that the exemption is engaged but the public interest favours disclosure of the information. The Commissioner requires the Cabinet Office to take the following steps to ensure compliance with the legislation - Disclose the withheld information with any junior names redacted under FOIA section 40 -“ personal information, in accordance with his guidance. The public authority must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
