The complainant has requested Christ's College Finchley (the College) to disclose the names of teaching staff who were employed by the College between 1984 and 1990. The College confirmed that it does not hold all the information but for the information it does hold it considers section 40 of FOIA (personal data) applies. The Commissioner's decision is that on the balance of probabilities the College does not hold any further recorded information to that already identified. In terms of section 40 of FOIA the Commissioner is satisfied that this has been applied appropriately to former member of staff which have left in the last six years. However, for current members of staff, he has decided that section 40 of FOIA does not apply. The Commissioner has also found the College in breach of section 10 of FOIA, by failing to respond to the information request within 20 working days of receipt. The Commissioner requires the College to disclose the names of current teaching staff which were employed between 1984 and 1990.
