The complainant has requested information from the Home Office regarding a hotel used to accommodate asylum seekers. The Home Office relied on section 12 of FOIA (cost of compliance) to refuse part of the request. The Commissioner's decision is that the Home Office was entitled to rely on section 12(1) of FOIA to refuse the request. The Commissioner also finds that the Home Office did not comply with its section 16 obligation to offer advice and assistance. The Commissioner requires the Home Office to take the following steps to ensure compliance with the legislation.
● provide the complainant with appropriate advice and assistance to help them submit a request that falls within the appropriate limit. The public authority must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
