NHS Resolution
The complainant has requested information relating to a claim they made to NHS Resolution. NHS Resolution has refused to disclose the requested information under section 40(1) of FOIA on the basis that it is the complainant’s own personal data. The Commissioner’s decision is that NHS Resolution was entitled to rely on section 40(1) of FOIA. However, he has recorded a procedural breach of section 17(1) of FOIA. The Commissioner does not require NHS Resolution to take any steps as a result of this decision notice.
