The complainant submitted a number of requests about estate service charges for a housing estate and about the landscaping service provided by Lambeth Parks. The London Borough of Lambeth (“the Council”) provided the complainant with some information by response, however stated that further recorded information within scope of the complainant’s requests was not held. During the course of the Commissioner’s investigation the Council sought to rely on regulation 12(4)(b) to refuse the complainant’s requests for information about Lambeth Pars/Landscapes. The Commissioner’s decision is that the Council is not entitled to rely on regulation 12(4)(b) to refuse the complainant’s requests for information about Lambeth Parks/Landscapes dated 17 July 2023, 15 August 2023, 17 September 2023, and 29 September 2023. The Commissioner requires the Council to issue the complainant with a fresh response to each of the requests that does not rely on regulation 12(4)(b). The public authority must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
