Oxford Direct Services Ltd
The complainant requested details of a contract between Oxford Direct Services Limited (‘ODSL’) and another company, Cuckoo Fish Limited. ODSL said that it does not hold any information, but clarified that its associated company, Oxford Direct Services Trading Limited (‘ODSTL’), would do. At review stage, ODSL upheld its decision that it does not hold the requested information. The Commissioner’s decision is that, on the balance of probabilities, ODSL was correct to state that it does not hold the requested information for the purposes of section 1 of FOIA. The Commissioner does not require ODSL to take any steps. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
