Chief Constable of South Wales Police
The complainant requested a copy of a final report produced by South Wales Police (SWP) that relates to Operation Dolomite. SWP disclosed a redacted version of the document, citing a number of exemptions under FOIA; section 31(1) – law enforcement, section 38 – Health and Safety, section 40(2) – personal information and section 42(1) - legal professional privilege. The Commissioner’s decision is that the exemptions cited are not applicable to all the withheld information. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: To disclose the information identified in a confidential annex which has been provided solely to SWP. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
