Bradford Children and Families Trust
The complainant requested information from Bradford Children and Families Trust (BCFT) relating to staff numbers. BCFT refused the request citing section 12 (cost limit) of FOIA. The Commissioner’s decision is that BCFT was not entitled to refuse to comply with the request under section 12(1) of FOIA. The Commissioner requires BCFT to take the following steps: Issue a fresh response to the request that does not rely on section 12(1) of FOIA. BCFT must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of FOIA and may be dealt with as a contempt of court.
