The complainant has requested information regarding the Lower Thames Crossing project. The Commissioner’s decision is that the appropriate legislation is the Environmental Information Regulations (EIR) and that the Cabinet Office is not entitled to rely on regulation 12(4)(e), internal communications, or 12(5)(f), interests of the person who provided the information, to withhold this information. The Commissioner requires the Cabinet Office to disclose the requested information. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Freedom of Information Act and may be dealt with as a contempt of court.
