Northamptonshire Police
The complainant has requested information from Northamptonshire Police regarding specified misconduct proceedings. Northamptonshire Police withheld the requested information citing section 31 of FOIA (law enforcement), section 32 of FOIA (court records), section 38 of FOIA (health and safety) and section 40 of FOIA (personal information). The Commissioner’s decision is that Northamptonshire Police were correct to rely on section 31 of FOIA to withhold the requested information. As this applies to all the withheld information, the Commissioner has not considered Northamptonshire Police’s application of the exemptions at section 32, section 38, and section 40 of FOIA. The Commissioner also considers that Northamptonshire Police breached section 10(1) of FOIA in that it failed to provide a valid response to the request within the statutory time frame of 20 working days. He does not require the public authority to take any further steps.
