Kirklees Council
The complainant requested legal advice relating to a planning application. Kirklees Council (the “council”) refused to provide the requested information citing the exceptions for internal communications (regulation 12(4)(e)) and the course of justice (regulation 12(5)(b) of the EIR. The Commissioner’s decision is that the council is entitled to rely on regulation 12(5)(b) of the EIR to refuse to provide the requested information. The Commissioner does not require the council to take any steps.
