Ashfield District Council
The complainant requested from Ashfield District Council (‘the council’), specific information about all of its employees. The council informed the complainant that some details are already published online. It therefore applied section 21 to this information. It withheld the remainder, applying section 40(2) of FOIA (personal data of third parties). The Commissioner’s decision is that the council was correct to rely on section 40(2) of FOIA to withhold the information. The Commissioner does not require the council to take any steps.
