The complainant has requested the equality impact assessments related to the policies included in the Transforming Support White Paper. The Commissioner’s decision is that section 35(1)(a) is engaged for the disputed information and the public interest lies in maintaining the exemption for the information relating to Occupational Health Market reform but favours disclosure for the information relating to the removal of the Work Capability Assessment. The Commissioner requires the Department for Work and Pensions (DWP) to disclose the costings and equality impact relating to the decision to remove the Work Capability Assessment. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
