The complainant has requested copies of Memorandums of Understanding (‘MOU’) between HM Coastguard and UK Border Force, since 1 January 2020. The Home Office confirmed that it held one MOU but refused to disclose it, saying that it was exempt under sections 31(1)(a) and (e) (Law enforcement) of FOIA. The Commissioner’s decision is that the Home Office was entitled to rely on sections 31(1)(a) and (e) to refuse the request. It also complied with section 1(1)(a) of FOIA. The Commissioner requires no steps as a result of this decision.
