The complainant requested all emails containing three specific words from a particular date and within a particular former employee’s email account. The Department for Transport (DfT) refused to comply with the request under section 14 FOIA as it considers it to be vexatious. The Commissioner’s decision is that the DfT was not entitled to rely on section 14(1) of FOIA to refuse this request. The Commissioner requires the public authority to provide a fresh response to this request not relying upon section 14 FOIA.
