The complainant has requested information about a prisoner complaint he submitted. The Ministry of Justice (‘MoJ’) disclosed some information, but refused to disclose the name of the decision maker for the complaint, citing section 40(2) (Personal information) of FOIA. The Commissioner’s decision is that the MoJ was entitled to apply section 40(2) to refuse the request. However, it breached section 10(1) (Time for compliance) of FOIA in its handling of the request. The Commissioner requires no steps as a result of this decision.
