Council for the Curriculum Examinations and Assessment
The complainant has requested from the Council for the Curriculum Examinations & Assessment (CCEA) correspondence between named individuals, minutes and notes regarding staffing and other operational matters. The CCEA provided some information but other information was withheld under sections 36, 40(1), 40(2), and 41 of FOIA. The Commissioner’s decision is that section 36 of FOIA has been cited correctly and that the public interest lies in maintaining the exemption. The CCEA was also entitled to withhold personal data under section 40 of FOIA. On the balance of probability, he has decided that the CCEA does not hold any further information. However the CCEA breached sections 10(1) of FOIA. The Commissioner does not require any further steps.
