The complainant has requested information regarding the development consent application for Wylfa Newydd Nuclear Power Station in Anglesey. The Commissioner’s decision is that the department formerly known as the Department for Business, Energy and Industrial Strategy (“BEIS”) is not entitled to rely on the exception at regulation 12(4)(d) – material in the course of completion. He considers that the exception at regulation 12(4)(e) – internal communication - is engaged, however the public interest favours disclosure of information in the scope of the request. The Commissioner requires the public authority to disclose the information as set out in the confidential annex. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of FOIA and may be dealt with as a contempt of court.
