The complainant has requested information concerning the Clearing House function of the Cabinet Office. The Cabinet Office initially refused the request under section 12 (cost limit) of the FOIA. Following a refined request from the complainant the Cabinet Office provided information requested in part 5 of the request; advised that they held no information within parts 1, 2 and 4 of the request, and withheld information requested in part 3 of the request under sections 36(2)(b)(i) and (c)(prejudice to the effective conduct of public affairs). The Commissioner’s decision is that he is satisfied, on the balance of probabilities, that the Cabinet Office do not hold any information requested in parts 1, 2 and 4 of the request. The Commissioner is satisfied that sections 36(2)(b)(i) and (c) are engaged to part 3 of the request but that in respect of some of the information held, the public interest in disclosure outweighs the public interest in maintaining the exemptions. The Commissioner requires Cabinet Office to take the following steps to ensure compliance with the legislation. Provide the complainant with an appropriately redacted copy of Annex B of the withheld information, as specified in the Confidential Annex attached to this notice. The Cabinet Office must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
