Department for Levelling Up, Housing and Communities
The complainant has requested information relating to a contract between the Department for Levelling Up, Housing and Communities (‘the Department’) and Faculty Science Limited (‘Faculty’). The Department refused to disclose the information requested in accordance with section 40(2) (personal information) and section 43 (commercial interests) of FOIA. The Commissioner’s decision is that: • The Department is entitled to rely on section 40(2) as its basis for refusing to disclose the personal data requested. • Aspects of the report engage section 43(1) (trade secrets) and the public interest lies in maintaining the exemption. • The rest of the report engages section 43(2) and the public interest lies in disclosure. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: • Disclose the report, with all information that engages section 43(1) redacted.
