Camden and Islington NHS Foundation Trust
The complainant has requested information relating to the services under Camden and Islington NHS Foundation Trust (‘the Trust’). In relation to parts 1-6 of the request, the Trust disclosed some information but confirmed that it does not hold any further information that falls within the scope of the request. In relation to part 7 of the request, the Trust has explained that it cannot comply citing section 12(1) (cost of compliance exceeds the appropriate limit) of FOIA. The Commissioner’s decision is as follows: On the balance of probabilities, the Trust does not hold any further information within the scope of parts 1-6 of the request. The Trust is entitled to rely upon section 12 as to comply with part 7 of the request would exceed the appropriate limit. The Trust has breached section 16 (duty to provide advice and assistance) in failing to provide meaningful advice and assistance to the complainant in relation to part 7 of their request. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation. • Provide meaningful advice and assistance to the complainant in relation to part 7 of their request.
