Driver and Vehicle Licensing Agency
The complainant has requested details of the registered keeper of a particular vehicle. The Driver and Vehicle Licensing Agency originally refused to confirm or deny that it held the requested information. It later confirmed that it did hold the information but relied on section 41 of the FOIA (actionable breach of confidence) to withhold it. The Commissioner’s decision is that the DVLA has correctly applied section 41(1) of the FOIA to withhold the information. However, as the DVLA failed to confirm, within 20 working days, that it held the requested information it breached section 10 of the FOIA. The Commissioner does not require further steps to be taken.
