The complainant requested a draft version of a report produced by the Independent Loan Charge Review. HM Treasury stated that it did not hold the requested information. During the course of the Commissioner’s investigation HM Treasury accepted that in theory it could conduct further searches, but estimated that to do so would exceed the appropriate limit at section 12 of FOIA. The Commissioner’s decision is that HM Treasury was entitled to rely on section 12 of FOIA to refuse the request. Accordingly no further steps are required.
