Judicial Appointments Commission
The complainant requested information relating to judicial appointments and candidate scoring. The Judicial Appointments Commission (JAC) provided some information within the scope of the request but refused to provide the remainder, citing section 22 (information intended for future publication), section 36(2)(c) (prejudice to effective conduct of public affairs) and section 40 (personal information) of FOIA. The Commissioner has investigated its application of sections 36(2)(c) and 40(2) of FOIA to the information withheld by virtue of those exemptions. The Commissioner’s decision is that the JAC was entitled to withhold the information on the basis of sections 36(2)(c) and 40(2) of FOIA. The Commissioner requires no steps to be taken as a result of this decision.
