The complainant has requested details of infants who died of pertussis in 2012. The above public authority relied on section 41 (breach of confidence) and 40(2) of FOIA (third party personal data) to withhold the information. The Commissioner’s decision is that the public authority has not demonstrated that either exemption is engaged and consequently is not entitled to rely on these exemptions.
