The complainant has requested from the Metropolitan Police Service (MPS) information relating to what the complainant describes as the relocation of the venue for a speech of the Prime Minister (PM) at the time, Theresa May, during a visit to Derby in 2018. The MPS refused to confirm or deny whether it held the requested information by citing sections 24(2) and 31(3). The Commissioner’s decision is that the MPS has incorrectly applied sections 24(2) and 31(3) FOIA. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: The MPS is required to confirm or deny whether the requested information is held and either disclose it or issue a fresh response compliant with section 17 of the FOIA.
