Financial Conduct Authority
The complainant requested information from the Financial Conduct Authority (“the FCA”) relating to the summary dismissal of employees and contractors for gross misconduct since April 2016. The FCA disclosed some information but withheld the requested information for points 1,2 and 4 under section 40(2) (personal information) of FOIA. The Commissioner’s decision is that the FCA were entitled to rely on section 40(2) (personal information) of FOIA to withhold the information. However, they failed to respond to the request within the statutory time frame of 20 working days and have therefore breached section 10(1) of FOIA. The Commissioner does not require any steps to be taken as a result of this decision notice.
