The complainant submitted an information request to the London Borough of Hammersmith and Fulham (“the Council”) for demographic information relating to children taken into care, and the record and transcript of a specific call and meeting. The Council refused to fully comply with part one of the request citing section 12 (cost limit) and in reference to parts two and three, it stated that it does not hold the information. The Commissioner’s decision is that the Council has correctly relied upon section 12(1) of FOIA for part one of the request and that, on the balance of probabilities, it does not hold information in relation to parts two and three. He also finds that the Council met its obligation under section 16(1) of FOIA to offer advice and assistance. However, in not providing the information within 20 working days, the Council did not comply with the requirements of section 10(1). The Commissioner does not require the Council to take any steps as a result of this decision notice.
