The complainant submitted an eight part request for information about a planning application. The London Borough of Croydon (“the Council”) refused parts [1] to [6] and part [8] of the request under regulation 6(1)(b) of the EIR, as the Council maintained that the information was reasonably available and accessible to the complainant via the Council’s online planning portal. In response to part [7] of the request the Council provided a narrative response. The Commissioner’s decision is that all of the information held by the Council within scope of parts [2] to [6] of the complainant’s request is readily available on the planning portal, therefore the Council is entitled to rely on regulation 6(1)(b) to refuse the request. The Commissioner considers that information within the scope of part [1] of the request was not readily available on the planning portal, therefore regulation 6(1)(b) does not apply. In respect of part [7] of the request, the Commissioner considers that further information is unlikely to be held by the Council. The Commissioner has not made a finding in respect of part [8] of the request in the absence of clarification from the complainant with regards to the information sought. The Commissioner does not require any steps.
