The complainant has requested information relating to F10 notifications. The HSE refused to comply with the request, citing section 14(1) (vexatious requests) of FOIA. The Commissioner’s decision is that: The request is vexatious and therefore the HSE was entitled to rely upon section 14(1) to refuse it. However, in failing to provide adequate advice and assistance to the complainant the HSE breached section 16 (advice and assistance) of FOIA. The Commissioner does not require the public authority to take any steps.
