The complainant requested information with regards to a complaint. Cambridgeshire County Council (the council) initially refused to provide the information as it considered it to be exempt under section 42(1) of the FOIA (legal professional privilege). During the Commissioner’s investigations it applied section 40(1) of the FOIA to refuse the information – the requestor’s own personal data. The Commissioner’s decision is that section 40(1) is engaged and the council was correct to refuse to provide the information. The Commissioner also found that the council breached section 17(1) of the FOIA as it failed to issue a valid refusal notice. As the Commissioner has found section 40(1) to be engaged, she does not require the council to take any steps.
