London Borough of Enfield
The complainant submitted a number of requests to the London Borough of Enfield (‘the Council’) concerning low traffic neighbourhood schemes as well as further requests on other issues. The Council initially responded to the requests but refused to answer any further requests on the basis of section 14(1) of FOIA because they were vexatious.The Commissioner has determined that all of the outstanding requests submitted to the Council by the complainant should be considered under the EIR rather than FOIA. However, she is satisfied that the Council is entitled to refuse to comply with all of these outstanding requests on the basis of regulation 12(4)(b) (manifestly unreasonable) of the EIR and that in all the circumstances of the requests the public interest favours maintaining the exception.
