Fareham Borough Council
The complainant has requested information from Fareham Borough Council (“the council”) regarding costs and payments for a property housing council tenants. The council provided some information in scope of the request, but withheld some information on the basis of section 40(2) (personal information) and section 43(2) of the FOIA (commercial interests). The Commissioner’s decision is that the council was correct to withhold some information on the basis of section 40(2). However it breached section 10(1) of the FOIA as it provided some information outside of the statutory timeframe of 20 working days. The Commissioner does not require any steps.
