The complainant requested from Department for Work and Pensions (“DWP”) information relating to a report on an investigation concerning an employee of the Home Office. DWP refused to confirm or deny whether it held the requested information and relied on section 40(5) (personal information) of the FOIA. The Commissioner’s decision is that DWP is entitled to rely on section 40(5B)(a)(i) of the FOIA to refuse to confirm or deny that it holds the information requested. Therefore, the Commissioner does not require DWP to take any steps as a result of this decision.
