The complainant has requested information about training in the Hare Psychopathy Checklist - Revised. Devon Partnership NHS Trust (‘the Trust’) is relying on section 12(1) of the FOIA to refuse to comply with the request as it says the cost of doing so would exceed the appropriate limit. The Commissioner’s decision is as follows: The Trust is entitled to rely on section 12(1) of the FOIA to refuse to comply with the complainant’s request. It would not be possible to refine the request meaningfully in order to bring complying with it within the cost limit. Therefore there was no breach of section 16(1) (advice and assistance). The Commissioner does not require the Trust to take any remedial steps.
