Plymouth City Council
The complainant has requested information relating to emission data from 2015 to 2020 from Plymouth City Council (the council). The council initially applied Regulation 12(4)(b) to refuse the request (manifestly unreasonable requests). However, during the course of the Commissioner's investigation the council reconsidered its position and disclosed the information to the complainant. The complainant, however, believes that not all of the information has been disclosed to him. The Commissioner’s decision is that, on a balance of probabilities, no further information is held falling within the scope of the complainant's request for information. She has, however, decided that the council did not comply with the requirements of Regulation 5(2) in that it did not disclose the information which it did hold to the complainant within 20 working days of the receipt of his request. The Commissioner does not require the council to take any steps.
