Chief Constable of Greater Manchester Police
The complainant requested information relating to a police officer found guilty of using racist language. The Chief Constable of Greater Manchester Police relied upon sections 30 (investigations), 38 (health and safety) and 40(2) of the FOIA (third party personal data) to withhold the requested information. The Commissioner’s decision is that GMP has correctly relied upon section 40(2) of the FOIA to withhold the requested information. However, in failing to respond to the request within 20 working days, GMP breached sections 10(1) and 17(1) of the FOIA. The Commissioner does not require further steps to be taken.
