Shropshire Council
The complainant has requested information relating to complaints made about a specific councillor. The Commissioner’s decision is that Shropshire Council (the council) has not correctly applied section 40(2) FOIA. Any information the council may hold would be personal data and therefore the Commissioner is proactively applying section 40(5B) FOIA to prevent the council from confirming or denying if it holds the requested information.
