Plymouth City Council
The complainant requested from Plymouth City Council (“the Council”) information regarding the Gormley sculpture. The Council withheld the requested information under section 43(2) (commercial interests) and subsequently applied section 40(2) (third party personal data) of the FOIA to the request. The Commissioner’s decision is that the Council correctly applied section 43(2) of the FOIA. Therefore, she has not gone on to consider the application of section 40(2) of the FOIA. The Commissioner does not require the Council to take any steps as a result of this decision.
